Unlike an email address a mobile phone number is a very personal and well guarded piece of information. When sending SMS marketing campaigns to people mobile marketers must respect that fact and when people do give consent for you to send mobile marketing messages to them that it is a privilege. The most important thing is to allow people to opt out of your SMS list at any time should they want to. This mechanism should be available via the text message and also via your website or at the point the person opted-in. The Burst SMS system has a built in sms opt out long code that you can use for free.
SMS compliance is governed by the Australian Communications and Media Authority (ACMA) and the Spam Act 2003. It comes under exactly the same rules and regulations as email and other electronic messaging. Direct consent is by opt-in via web form or SMS. Inferred consent is more complicated. See our Spam Policy for more.
Either an instruction or better yet with an SMS opt out by replying with a STOP command to the message.
Do not forget to identify yourself in the message or the CallerID.
Use a dedicated long code so people can text to opt-in or we have web form code that can be pasted into your site.
Just select our long code as the caller id when you send your message and the opt-out is added automatically.
